The leading Fuji musician, Wasiu Ayinde Omogbolahan Marshall, popularly known as KWAM 1, has withdrawn the suit he filed at the Ogun State High Court challenging steps taken towards the installation of a new Awujale of Ijebuland.
A notice of discontinuance dated 22 December and filed at the High Court in Ijebu Ode shows that Oluaye Fuji, as he is fondly called, formally discontinued the case against all the respondents, including Ogun State Governor Dapo Abiodun.
Other respondents to the now terminated suit were officials of the Ijebu-Ode Local Government, the state attorney general, and the Fusengbuwa Ruling House.
Confirming the withdrawal, the Vice Chairman of the Fusengbuwa ruling house of Ijebu Ode and the lawyer holding brief for the family, Prof. Fassy Yusuf, on Wednesday, affirmed that Alhaji Wasiu Ayinde, has truly withdrawn the suit filed against the state government and the ruling house over the selection process of the next Awujale of Ijebu land.
Ayinde, in a notice of discontinuance dated December 22 and filed before the state High Court sitting in Ijebu Ode, was said to have told the court of his wish not to pursue the suit again and therefore urged the court for discontinuance of the suit.
Prof. Fassy Yusuf confirmed confirmed on phone to a Punch correspondent, that Ayinde filed the discontinuance of the suit on Monday shortly after the court declined to grant the musician an order of interim injunction seeking to stop Gov Dapo Abiodun, the Fusengbuwa ruling house and four others from taking further steps over the selection process of the next Awujale of Ijebu land.
“I can confirm that Wasiu Ayinde has filed a notice of discontinuance of the suit instituted against Gov Dapo Abiodun, the Fusengbuwa ruling house, the Awujale Interregnum Administration Committee, the Chairman of Ijebu Ode Local Government and others.
“On Monday, his exparte motion came up for hearing, but unfortunately, the presiding judge, Justice A A Omoniyi, declined to grant the order of interim injunction seeking to stop the selection process of the Awujale.
“Maybe after due consultation with his legal counsel, he decided to withdraw the suit, having suffered defeat when the case came up for hearing on Monday and decided to file a withdrawal of the suit; nobody knows.
“The truth, however, is that the Fuji musician has filed for the discontinuance of his suit against the government and our family, and this application would be formally heard on January 14, which is the next adjournment day for the suit.
